Ellora's Cave sues Dear AuthorUpdate at the bottom: alternative ways to contribute to Dear Author/Jane Litte’s defense. Also, still updating the humongous list of links.

When Jane Litte announced that she had been sued by Ellora’s Cave, many of us came out of the woodwork, offering to help her financially. For the past five days, nothing about a fund was said, until today.

After all, etaining First Amendment badass Marc Randazza ain’t cheap–it’s an excellent notion, but not cheap–and so her friends have prevailed.

The Dear Author/Jane Litte defense fund has been created by Sarah of the ever Smart Bitches through GoFundMe. From the fund’s front page (emphasis mine):

Many people have been asking if and how they can contribute to Dear Author and Jane Litte’s legal defense. Consequently, this campaign was created. The Dear Author Jane Litte Legal Defense Fund will be run through Go Fund Me. Any donations made to this fund will be used for Jane Litte’s defense against the defamation suit filed against her and Dear Author Media Network LLC by Ellora’s Cave.

Why a fund?

Because lawsuits are expensive (that’s why they’re so often used as a threat, if you’ve ever wondered). Because of that, and because the duration of the litigation is undetermined, Jane will need financial assistance. Jane’s attorney, Marc Randazza, is contributing by discounting his hourly rate. Even with a generous discount, it’s still expensive.

Jane Litte has set aside $20,000.00 of her own funds to fight this defamation suit and has paid the large retainer out of the fund but that money will be depleted quickly as the case progresses.

If you’d like to donate to the legal fund, you can follow this link to the GoFundMe site, and make your donation. Please note: these are NOT tax deductible donations, as this is NOT a 501(c)3 not-for-profit
entity.

All funds will be used for Jane’s legal defense, minus the fees charged by GoFundMe, and because we don’t know what the end result will be, we have no way of knowing what the total amount required will be. If there are any funds left over when the suit is finished, they will be donated to the Society of Professional Journalists Legal Defense Fund ( http://www.spj.org/ldf.asp).

If the fees do not exceed $20,000, we will attempt to refund the donations per the GoFundMe policies ( http://support.gofundme.com/entries/22603558-How-do-I-issue-a-refund-to-a-donor-). Countries with the following currencies are supported: $ USD, £ GBP, $ CAD, $ AUD and € EUR.

Any amount that you can contribute is most appreciated.

In the past few days I’ve seen more than a couple of places advising bloggers and commenters to be more circumspect, be more careful–lest they be sued too. And that, right there, is a threat to freedom of speech. No, I am not advocating that people screech vitriol at each other without constraint, but when we are continually censoring ourselves for fear to offend–and that the offended party may sue us–we stop saying anything about the things that matter.

I’m usually broke, but I can give a few dollars now, and will likely give a few more as I can–because the other thing is that lawsuits are rarely–if ever–quick. If we are in, we are in for the long haul. Here’s to freedom of speech, and best wishes to Jane.

Holly SHIT, people! In less than 24 hrs, the romance community has raised over $30,000.00 for the Dear Author/Jane Litte legal defense fund. As I said elsewhere, I’m a cynic, but today, romance readers and romance writers, and people all over who care about free speech have rocked my world, so hard.

Tears in my eyes, people, no exaggeration.

    So, what’s the problem with GoFundMe? I’ve heard nothing.

      Over at Dear Author, Ridley left this comment:

      A reminder that GoFundMe profits off the murders of black men and boys and helps their murderers escape prison time. Also, GoFundMe is not “neutral.” You can use their platform to help someone get away with murder, but you can’t use it to fund an abortion.

      I did a quick search and found what I believe are the two instances that have provoked an ongoing boycott of GoFundMe.

      The earlier was that it allowed extremely racists comments to be posted to two different fundraising campaigns to benefit the cop who shot Michael Brown in Ferguson. Here’s an example:

      ()a donator going by Brady Moody thanked the all police for being “the ‘Thin Blue Line’ protecting normal Americans from aggressive and entitled primitive savages.”

      Apparently, even though comments for both these fundraisers have been disable, the fundraisers were left open (presumably until their goals were reached or their time was up).

      The second incident involved removing a fundraising effort to fund a second trimester abortion, apparently on the basis that:

      “In the event that a campaign contains questionable content, GoFundMe will conduct an internal content review to determine the most appropriate course of action. Given the sheer volume of campaigns, each review is handled on a case-by-case basis.”

      The inescapable conclusion is that, in GoFundMe’s eyes at least, allowing fundraising by openly racist assholes is apparently not questionable, but a woman’s right to chose, totally is.

      And, according to their Wikipedia entry, they will allow fundraising for anti-abortion/anti-choice initiatives.
