So interesting (EC v DA related)

Ellora's Cave sues Dear AuthorI have been vocal here and elsewhere about my opinion (protected speech, yo!) that the twitter Nut and Tina Engler/Jaid Black are one and the same. Deirdre Saoirse Moen has reached the same conclusion, based on some writing ticks I wasn’t aware of, never having read anything that TE/JB or any of her aliases have ever written.

I confess that Deidre makes a compelling argument there, but my reasons for believing that Tina and the Nut are one and the same person are based more on what the Nut says than on how it says it.

In my opinion (yes, still protected speech), Ellora’s Cave is suing Dear Author and Jane Litte to scare anyone and everyone into keeping quiet about their own issues with EC–lack of payment being the most common, going by all the people who have so far spoken about missing checks, back-dated checks, sketchy royalty statements, etc etc.

But beyond the suit, Tina Engler’s reaction to any criticism of her as person, or of her company, or of her company’s practices, is always an attack and always unfair, and often she considers any contradiction to her statement as slanderous or libelous.

The fact that statements of truth and statements of opinion cannot, by US law, be considered defamation, appears to mean little to nothing to Tina Engler.

Which is likely another justification, in her own eyes, to sue Dear Author and Jane Litte, and to not-so-subtly threaten her own authors and other contractors and employees with further lawsuits.

Not-so coincidentally, that’s exactly the tack that the Nut takes again and again, whenever anyone tries to school it on what is actually going on or what the law provides for.

The tenor of the Nut’s entire performance is the same one note as Tina’s “woe is me” posts and comments about the suit and can, I think, be summed up as follows:

Everyone who dares say anything against Ellora’s Cave; or against Tina Engler/Jaid Black; or who supports Jane Litte and/or Dear Author; or who support any of the people who have already spoken in support of Jane Litte and/or Dear Author, as well as Jane Litte and those who have spoken in support of her, will rue the day they did so.

Which is why I wasn’t surprised in the least when Julie Naughton reported that she, like Jane Litte, has received harassing emails at work:

As note, I’m not posting any of the Nut’s ramblings at the moment, but that doesn’t mean there aren’t screenshots. Eventually, it is my hope that the identity behind this account, as well as that behind those harassing emails, will be determined and made to face legal consequences.

Wouldn’t that be lovely?

    I’m so saddened by all this because despite people’s claims to the contrary, Ellora’s Cave was the first erotic romance site by women, for women and it started the careers of many talented authors. And the failure of the Cave really can all be seen as bad business sense (the prices, the covers, the horrendous website).

    But they were the first and the foremost. Being pubbed by EC mattered to careers and to see it all disappear in dross and stupidity is so depressing.

    I wish TE was emotionally better prepared to deal with all this and not take the company down, but that isn’t meant to be. By the time she’s done, EC will be buried and the strides she made for women in romance will be forgotten instead of celebrated as it should have been.
